RESTRUCTURING STATUS
States with Final Electric Restructuring Laws and Dates Set for Full Retail Choice

Arkansas – 2002 Law allows customers to choose suppliers beginning Jan 1, 2002

California – 1998 Landmark bill became law in 1996. Retail competition began officially on March 30, 1998

Connecticut – 2000 Law provides full choice to all customers on July 1, 2000

Delaware – 2001 Restructuring law authorizes phase-in of retail choice from Oct. 1, 1999 to April, 2000

Illinois – 2002 Law provides for transition to full retail access from Oct. 1, 1999 to May 1, 2002

Maine – 2000 Law opens customer choice for all on March 1, 2000

Maryland – 2002 Restructuring statute phases in choice by thirds from July 1, 2000 to July 1, 2002

Massachusetts – 1998 Open access for all customers began on March 1, 1998 as required by law

Montana – 2002 Transition to full retail access began July 1, 1998, all have access on July 1, 2002

Nevada – 2001 Law called for transition beginning on December 31, 1999, with completion on October 1, 2001. In May, 1999, the legislature amended the law, moving the start to March 1, 2000.

New Hampshire – 1998 A target date of January 1, 1998 was set by law, but legal and other issues have delayed competition. PUC action and enabling legislation are required to implement customer choice.

New Jersey – 1999 Restructuring law would have begun full competition on August 1, 1999. In July, 1999 the beginning date was moved forward to November 14, 1999

New Mexico – 2002 Law signed in March 1999 provides for transition period from January 1, 2001 to January 1, 20002

Ohio – 2005 Law calls for five-year transition beginning on January 1, 2001

Oklahoma – 2002 A 1997 law mandates full retail choice by July 1, 2002, and requires approval by the Oklahoma legislature

Oregon – 2001 Law allows industrial and commercial electric customers full choice of suppliers beginning October 1, 2001. Residential customers will have more limited choice involving portfolios.

Pennsylvania – 2000 Law provided for phase-in of retail choice. Two-thirds of the state’s electricity customers were given retail choice on January 1, 1999, and the remaining third on January 1, 2000

Rhode Island – 1998 Law required full retail choice by July 1, 1998. It began ahead of schedule on January 1, 1998.

Texas – 2002 Full competition in the electricity market opens on January 1, 2002

Virginia – 2004 Deregulation law sets January 1, 2002, as the starting date and January, 2004 for full retail access.


STATES IN WHICH THE PUBLIC SERVICE COMMISSION (PSC) HAS MANDATED RESTRUCTURING OR ISSUED A FINAL RESTRUCTURING REPORT

Arizona – 2001 The Arizona Corporation Commission adopted rules in 1996 and approved a permanent order in 1998 for phase-in beginning January 1, 1999. The plan was stayed and amended. Retail electric competition rules were adopted in September, 1999, putting into place a plan that brings choice to all customers by January 1, 2001

Michigan – 2002 In 1998 the PSC issued final restructuring orders for the implementation of customer choice by January 1, 2002. The PSC issued another order in August, 1999 allowing the two major elective utilities to voluntarily implement retail choice programs in September 1999.

New York – 2000 The PSC mandated retail access by 2000

Vermont – 1998 The Vermont Public Service Board issued a final report calling for transition to full access by the end of 1998. However, comprehensive restructuring legislation has not been passed.
